General terms and conditions (GTC), warranty and guarantee

1.) Scope

These general terms and conditions apply in the current version at the time a contract is concluded for all business relationships between VV Interior Viollaz, Dagmersellen and their customers. They form an integral and complementary component for all orders and purchases that are completed in writing, online or in person.

2.) Offers

The range shown at vvinterior.com does not represent a legally binding offer. The presentation on the Internet is non-binding. If the customer places an order via internet, email, mobile phone, telephone or fax, he is making a binding offer to conclude a purchase contract. The customer receives confirmation that the order has been received. This confirmation does not constitute acceptance of the offer by VV Interior Viollaz. VV Interior Viollaz reserves the right to reject the application without giving reasons. A legally binding purchase contract is only concluded when VV Interior Viollaz sends an order confirmation or when payment for the goods/services is made. Decorative items shown in the pictures are not part of the offer unless listed and mentioned by name. Accessories and decorative items must be purchased separately. In addition, VV Interior Viollaz assumes no liability with regard to the correctness, accuracy, timeliness, reliability and completeness of the information provided. This also applies to the availability, location, price and all information related to the details of the products offered such as design(s), manufacturer, time/epoch, color, dimensions, material, weight, condition, type of furniture, etc.

3.) Prices

All prices are net, including VAT and plus any collection/delivery and assembly costs. These are offered individually.

4.) Property

The goods remain the property of VV Interior Viollaz until the purchase price has been paid in full.

5.) Vouchers

Vouchers are only accepted for the amount shown on the voucher. The validity of a voucher is determined by the internal documents of VV Interior Viollaz, which provide information about whether the voucher amount has already been redeemed.

Unless otherwise stated, vouchers are valid indefinitely. If the voucher value is not reached when purchasing, the difference will be given back as a voucher value. A cash payment is not possible. Vouchers can be given as payment for all services and purchases at VV Interior Viollaz, whereby the execution of external work for voucher credit is excluded.

6.) Warranty/Guarantee

VV Interior Viollaz primarily deals in used goods and individual items.

Therefore, it is unfortunately not possible to comply with the statutory warranty obligations. The law therefore allows any warranty to be excluded. For purchases from VV Interior Viollaz, it is therefore agreed that any warranty, to the extent possible under the law, is excluded; in particular, cancellation and reduction are excluded.

Otherwise, the Code of Obligations applies.

The buyer checks the goods immediately after purchase/receipt for any defects. Visible defects and signs of wear are accepted as found. Defects that become apparent later, including hidden defects, are not a reason for free repair or return. The rule is “Bought as seen.” The only exceptions to this are defects in connection with commissioned workshop work that was carried out in our own workshops.

Excerpt from the Code of Obligations

Exemption condition (OR II – Art. 199): An agreement on the cancellation or limitation of the warranty obligation is invalid if the seller has fraudulently concealed the warranty defects from the buyer.

Defects known by the buyer (OR II – Art. 200): The seller is not liable for defects that the buyer was aware of at the time of purchase. The seller is only liable for defects that the buyer should have been aware of if he had exercised normal attention if he has guaranteed that they do not exist.

7.) Exchange/Return

There is no right of return or exchange. If a return or exchange is nevertheless made as a gesture of goodwill, a voucher will be issued in the amount of the amount paid less any transport costs and/or defects/damage that reduce the value as well as the loss in value since purchase. Damage to lamps is also excluded from the warranty. All further claims are excluded. A processing fee of CHF 100 will be charged for each return.

The copyright to our website, our sales exhibitions and their content such as texts and graphics (not an exhaustive list) lies entirely with VV Interior Violla

9.) Transport/assembly

For an additional charge, VV Interior Viollaz delivers purchased objects to the buyer or third parties named by the buyer and assembles them upon express request. VV Interior Viollaz also collects purchased objects or goods for repair from clients for a fee. In the event of damage or loss, VV Interior Viollaz is liable for a maximum of the agreed purchase price. It is the responsibility of the buyer/client to insure collected goods or to insure purchased goods in excess of the purchase price. Any damage or defects must be reported by telephone and in writing immediately after they are discovered. Otherwise no liability can be assumed. A delayed delivery, for whatever reason, does not entitle you to withdraw from the purchase or to make any other claims of any kind.

10.) Applicable Law

Swiss law applies exclusively.
